Sen. Marsha Blackburn unveiled a new AI framework proposal Wednesday that would enshrine into law President Donald Trump’s executive order to create a national standard for artificial intelligence. The Tennessee Republican's discussion draft, titled the TRUMP AMERICA AI Act, comes as lawmakers are scrambling to respond to the Trump administration's calls for Congress to establish a federal AI framework that would preempt states eager to implement their own piecemeal regulations on how to use the emerging technology. Senate Majority Leader John Thune and Commerce Chair Ted Cruz (R-Texas) have also been working with the White House to hammer out a national AI blueprint that could include a formal preemption provision and be folded into a larger package of kids’ online safety bills.

Blackburn’s proposal, like the one she rolled out in December, would incorporate the Kids Online Safety Act and NO FAKES Act, alongside a prohibition on states regulating AI outside of a single national standard. A new addition in her blueprint announced Wednesday is a provision that would codify Trump's ratepayer protection pledge requiring tech companies to supply or pay for the electricity used by the data centers they operate. It would include an executive order intended to eliminate “woke” AI from government, as well as direct the National Institute of Standards and Technology to set federal guidelines for authenticating and detecting AI-generated content and develop cybersecurity measures to prevent tampering with AI watermarking.
